Terms of Service

These Terms of Service govern your use of the TankerNow platform. Please read them carefully. They describe your rights and responsibilities as a user of TankerNow, whether as a customer or a driver, and provide important legal protections under the laws of the Islamic Republic of Pakistan.

Legal Warning: The name "TankerNow", its logo, and all associated branding are protected under the Trade Marks Ordinance, 2001 and Copyright Ordinance, 2000 of Pakistan. Unauthorised use or imitation is a criminal offence. Any misuse of the TankerNow platform digitally may be prosecuted under PECA 2016 through the FIA Cyber Crime Wing.

1Acceptance of Terms

  • By downloading, installing, or using the TankerNow mobile application or website, you agree to be bound by these Terms of Service.
  • If you do not agree to these terms, please do not use TankerNow.
  • TankerNow reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the updated terms.
  • These Terms constitute a legally binding agreement under the laws of the Islamic Republic of Pakistan.

2Intellectual Property & Trademark Notice

  • The name "TankerNow", its logo, wordmark, colour scheme, app interface, and all associated branding are the exclusive intellectual property of TankerNow and its founder.
  • TankerNow is a registered trade name protected under the Trade Marks Ordinance, 2001 (Act No. XIX of 2001). Unauthorised use, imitation, or reproduction of the TankerNow name, logo, or brand identity is strictly prohibited and constitutes a criminal offence under Section 38 of the Trade Marks Ordinance, 2001, punishable by imprisonment of up to three years and/or a fine.
  • All website content, application code, graphic designs, text, images, logos, and software are protected under the Copyright Ordinance, 2000 (Ordinance No. XXXIV of 2000). Reproduction, redistribution, modification, or commercial use of any TankerNow content without prior written permission is an infringement of copyright and may result in civil and criminal liability.
  • Any person or entity that creates a website, app, business, or service that copies or imitates the TankerNow name, brand, design, or concept will be subject to legal action including injunctions, damages, and criminal prosecution under applicable Pakistani law.
  • Cybersquatting — the registration of domain names, social media handles, or app store listings that imitate or misappropriate the TankerNow brand — is a violation of the Trade Marks Ordinance, 2001 and the Prevention of Electronic Crimes Act, 2016 (PECA 2016). Offenders will be reported to the Federal Investigation Agency (FIA) Cyber Crime Wing.

3Platform Nature — Marketplace Disclaimer

  • TankerNow is a technology marketplace platform. It is not a water delivery company. TankerNow does not own tankers, employ drivers, or deliver water.
  • TankerNow connects independent water tanker drivers with customers seeking delivery services. All deliveries are performed solely by independent drivers who operate as self-employed contractors.
  • Drivers listed on TankerNow are independent service providers and are not employees, agents, partners, or representatives of TankerNow in any capacity.
  • TankerNow is not responsible for — and expressly disclaims all liability for — the actions, omissions, conduct, or negligence of any driver during or after a delivery. Any dispute arising from a delivery transaction is between the customer and the driver.
  • TankerNow does not guarantee the quality, safety, cleanliness, or quantity of water delivered by any driver. Customers accept that they are contracting directly with the driver.
  • In the event of any legal complaint, FIR, or dispute arising from a delivery transaction, TankerNow will provide relevant platform records to authorities as required by law, but TankerNow itself shall not be held party to any such dispute between a customer and a driver.

4The TankerNow Service

  • TankerNow provides a digital platform for order placement, driver matching, real-time tracking, and delivery management.
  • Service availability is limited to defined service zones. Orders placed outside these zones will not be accepted.
  • TankerNow verifies driver identity and credentials at registration. However, identity verification does not constitute an endorsement of the driver's services or an assumption of liability for their conduct.
  • TankerNow reserves the right to modify, suspend, or discontinue any part of its service at any time without liability.

5Customer Responsibilities

  • You must provide accurate delivery information including your correct address and a reachable contact number.
  • You must be available to receive your delivery at the time of arrival. Failed deliveries due to customer unavailability are the customer's responsibility.
  • You are responsible for ensuring safe access to your delivery location for the driver.
  • Cancellations should be made as early as possible. Repeated last-minute cancellations may result in account restrictions.
  • You must not engage in abusive, threatening, or disrespectful behaviour toward drivers. Threatening or abusing a driver may constitute an offence under the Pakistan Penal Code, 1860 (PPC), including but not limited to Section 506 (criminal intimidation).
  • Filing a false or malicious complaint against TankerNow or any driver may constitute an offence under Section 182 of the PPC (false information to a public servant) and may result in counter-legal action.

6Driver Terms

  • Drivers must complete the full registration and document verification process before becoming active on the platform.
  • Drivers must maintain their vehicle in safe, roadworthy condition at all times in compliance with the Motor Vehicles Ordinance, 1965.
  • Drivers must deliver only clean, safe water and are solely and personally responsible for the quality and quantity of water they supply.
  • Drivers must not share their account, allow unauthorised individuals to use their profile, or misrepresent their identity.
  • Drivers who receive repeated negative ratings, complaints, or policy violations may be suspended or permanently removed from the platform.
  • Drivers are responsible for compliance with all applicable local laws, including but not limited to traffic laws, water safety regulations, and business registration requirements.
  • Drivers acknowledge that they are independent contractors and that no employer–employee relationship exists between them and TankerNow. TankerNow is not responsible for any statutory benefits, insurance, or liability arising from the driver's activities.

7Payments and Commission

  • All payments for water delivery are made directly between customers and drivers — cash on delivery.
  • TankerNow charges a platform commission on each completed delivery. The applicable commission rate is communicated to drivers at onboarding.
  • Commission is recorded automatically for each completed delivery and settled according to the agreed schedule.
  • TankerNow reserves the right to adjust commission rates with reasonable notice to drivers.
  • Any attempt to evade platform commission by conducting off-platform transactions after an initial connection through TankerNow is a material breach of these Terms and may result in immediate account termination and recovery of owed amounts.

8Prohibited Conduct

  • Using TankerNow for any unlawful purpose under Pakistani law.
  • Attempting to circumvent the platform by conducting transactions off-platform after an initial connection through TankerNow.
  • Providing false information during registration or order placement — this may constitute fraud under Section 420 of the PPC.
  • Harassing, threatening, or abusing other users of the platform.
  • Attempting to manipulate ratings or reviews through fraudulent means.
  • Using automated tools, bots, or scripts to interact with the platform — this may constitute an offence under PECA 2016.
  • Copying, replicating, or impersonating the TankerNow brand, name, or platform in any form.
  • Making false statements about TankerNow in public forums, media, or social media that could constitute defamation under applicable law.

9Cyber Misuse & Digital Protection

  • Any unauthorised access to TankerNow's systems, databases, or user accounts is an offence under Section 3 of the Prevention of Electronic Crimes Act, 2016 (PECA 2016), punishable by imprisonment of up to two years and/or a fine.
  • Phishing, spoofing, or creating fake websites or apps impersonating TankerNow is an offence under Section 16 of PECA 2016 (cyberstalking and identity fraud provisions) and Section 36 (electronic fraud).
  • Posting false, misleading, or defamatory content about TankerNow or its users online may constitute an offence under Section 20 of PECA 2016 (offences against dignity) as well as defamation under the Defamation Ordinance, 2002.
  • TankerNow actively monitors for digital misuse and will report any such activity to the FIA Cyber Crime Wing and relevant authorities without prior notice.

10Limitation of Liability & Indemnification

  • TankerNow provides the platform on an "as-is" basis and makes no guarantees about uninterrupted availability of the service.
  • TankerNow is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the platform.
  • TankerNow is not liable for damages arising from delays, cancellations, or quality issues with water deliveries performed by independent drivers.
  • TankerNow's maximum aggregate liability to any user shall not exceed the value of the specific transaction in dispute.
  • By using TankerNow, you agree to fully indemnify, defend, and hold harmless TankerNow and its founder, officers, and representatives from and against any and all claims, losses, liabilities, costs, or expenses (including legal fees) arising from: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) any dispute between you and a driver; or (d) any third-party claims arising from your conduct on the platform.

11Governing Law & Jurisdiction

  • These Terms of Service are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
  • Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the TankerNow platform shall be subject to the exclusive jurisdiction of the courts of Rawalpindi / Islamabad, Pakistan.
  • By using TankerNow, you irrevocably submit to the personal jurisdiction of such courts and waive any objection to proceedings in such courts on grounds of venue, inconvenient forum, or otherwise.
  • Nothing in this clause limits TankerNow's right to seek injunctive or other equitable relief in any court of competent jurisdiction.

12Dispute Resolution

  • In the event of a dispute between a customer and a driver, TankerNow will make reasonable efforts to facilitate resolution. Both parties are encouraged to first attempt resolution through TankerNow's in-app support.
  • TankerNow encourages amicable resolution of disputes before any formal legal proceedings. In the event of a dispute involving TankerNow directly, parties agree to first attempt resolution through good-faith negotiation within 30 days of written notice.
  • If direct negotiation fails, the parties agree to attempt mediation through a mutually agreed mediator before initiating formal legal proceedings.
  • Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

13Legal Warning — Brand Protection

  • TankerNow takes the protection of its intellectual property, brand, and platform seriously. Any attempt to copy, imitate, or misuse the TankerNow brand, concept, or platform will be met with the full force of Pakistani law.
  • Legal remedies that TankerNow may pursue include: civil injunctions to stop infringing activity; damages and account of profits under the Trade Marks Ordinance, 2001 and Copyright Ordinance, 2000; criminal prosecution under PECA 2016 and the Pakistan Penal Code, 1860; and complaints filed with the FIA Cyber Crime Wing, PTA (Pakistan Telecommunication Authority), and other relevant regulatory bodies.
  • TankerNow maintains records of all registered users, orders, interactions, and communications on the platform. These records constitute legal evidence and will be produced in any court or regulatory proceeding as required.
  • If you believe your intellectual property rights have been violated, or if you have a legal concern related to TankerNow, contact us at: support@tankernow.com before initiating any legal action.

14Account Termination

  • TankerNow may suspend or terminate any account that violates these Terms of Service, with or without notice.
  • Users may close their account at any time by contacting support.
  • TankerNow reserves the right to retain certain data after account closure as required by law, court order, or for legitimate business and audit purposes.
  • Termination of an account does not release a user from obligations or liabilities incurred prior to termination.

Key legislation referenced herein includes the Trade Marks Ordinance 2001 (Act XIX of 2001), Copyright Ordinance 2000 (Ordinance XXXIV of 2000), Prevention of Electronic Crimes Act 2016 (PECA 2016), Pakistan Penal Code 1860 (PPC), and the Defamation Ordinance 2002. Nothing in these Terms limits any rights granted by applicable law.
